This web page represents a legal document and is the Terms and Conditions (“Terms”) for our website latinxtherapy.com (“Website”). By using our Website you agree to fully comply with and be bound by the following Agreement each time you use our Website. Please review the following terms carefully.

Definitions

The terms “we”, “us”, and “our” refer to Latinx Therapy.  The term “Site” refers to latinxtherapy.com and latinxtherapy.club, and any other domains operated by Latinx Therapy that link to these Terms and Conditions. The term “user,” “you” and “your” refers to site visitors, customers and any other users of the site.

All text, information, graphics, design, photos, images, materials, documents, data and intellectual property accessible on or offered through our Website or Services, are collectively known as our “Content” is our property and is protected by the United States intellectual property laws.  On the Site we provide information related to mental health, mental illness, and therapy (the “Service”).

Use of the Site including all materials presented herein and all online services provided by us, whether made available for purchase or not is subject to the following Terms.  These Terms apply to all site visitors, customers, and all other users of the site.  By using the Site or Service, you agree to these Terms, without modification, and acknowledge reading them.

Intellectual Property Rights

All content on this Site and Service—including trademarks, copyrights, proprietary information, designs, text, graphics, and the overall “look and feel”—is the exclusive property of Latinx Therapy (legally: Adriana Alejandre). Your use of our Website or Services does not grant you any rights to our intellectual property.

You may not modify, distribute, reproduce, publish, create derivative works from, or exploit any content without our prior written consent. Unauthorized use may result in removal from the Site and/or Service without refund.

You may use our content for personal, non-commercial purposes and hyperlink to it with full attribution, ensuring copyright and trademark notices remain intact.

Limited License

We grant you a nonexclusive, nontransferable, revocable license to access and use our Website and Services strictly in accordance with this Agreement. Your use of our Website and Services are solely for internal, personal, noncommercial purposes, unless otherwise provided in this Agreement. No printout or electronic version of any part of our Website or Services may be used by you in any litigation or arbitration matter whatsoever under any circumstances.

Your License to Us

You grant us a license to use the information and materials you post to our Website.  By posting, displaying, transmitting, performing, or otherwise distributing information or other content (“Visitor Content”) to our Website, you are granting us and any affiliates, a license to use the Visitor Content in connection with the operation of our business, including without limitation, a right to distribute, copy, transmit, publicly display, reproduce, translate, edit, and reformat your Visitor ­content. You understand and agree that you will not be compensated for any Visitor Content. By posting Visitor Content on our Website or Service, you warrant and represent that you own the rights to the Visitor Content or are authorized to post, display, distribute, perform, or transmit Visitor Content.

Membership & Subscription Services

• Each membership is for a single user unless otherwise stated.
• Directory listings will be verified within 2-5 business days.
• Due to the directory being a digital service, refunds are not provided for membership while your profile was active.
• Billing occurs at the start of each billing period. No prorated refunds for cancellations mid-cycle.
• If membership fees are unpaid, access may be suspended until payment is made.
• If a profile is inactive for over three months, it may be deleted unless otherwise requested.
• Only monthly plans carry a 30 day trial period.
• Instagram Ad Program: For any edits and reposts a cost of $10 will be expected, per publishing. This program is included in the Premium, and for former Standard $21/mo subscribers.  For Basic tier members, a cost of $25/calendar year will be expected, and each published edits will require an additional $10. 
• For all tiers: any extra Instagram ad is $25/calendar year.

Latinx Therapy offers different membership tiers, each with specific benefits and pricing. The details of each tier, including benefits, fees, and included services, are outlined at latinxtherapy.com/join.

By subscribing, you agree to the terms associated with your selected membership tier. Membership benefits and pricing may change at our discretion. Any updates will be reflected on our website and communicated to active members with 3 months’ notice.

Payment & Fees

• All fees are stated on the Site and are subject to change.
• Payment is processed via Stripe, and members authorize recurring charges.
• Instagram ad edits or reposts incur additional fees.

Listing Approval Time

• All submitted profiles will undergo a verification process before appearing on our directory map. Approved profiles will be listed within 2-5 business days of submission. If there are errors or missing information, processing may take longer. For any questions regarding your listing status, please contact members[@] latinxtherapy.com

Each meeting is 1 hr unless otherwise stated. Dates and topics may be subject to change. Links will be sent the week of and posted in your dashboard under the Membership Perks tab. 

*Selected consultations and Speaking consultations will be recorded and saved in our community on LatinxTherapy.club for our Premium members and $21/mo grandfathered plans.

Peer/Clinical/Marketing consultations will be for clinical cases, peer support and/or networking. Priority will be given to the majority. These consultations will not be recorded.

Refund Policy

1. Subscription & Service Fees

• Latinx Therapy does not offer refunds on subscriptions or service fees.
• Charges apply for the full billing period, regardless of subscription start, cancellation, or account changes.
• No prorated refunds for partial use of services.
• Latinx Therapy may issue refunds in special cases, such as documented technical errors, duplicate charges, or other extenuating circumstances beyond the user’s control. Requests will be reviewed on a case-by-case basis, and an administrative fee of $15 may apply.

2. Online Courses & Webinars

• Refund requests must be made at least 7 days before the course/webinar start date.
• A 7% administrative fee (based on the course/webinar price) will be deducted from the refund.
• No refunds for requests made less than 7 days before the course/webinar.
• No refunds if a participant fails to complete or pass the course.
• No credit nor transfer will be permitted.
• Refunds may take 5-10 business days to process. 

3. Live Event Refunds

• Refund requests must be made at least 7 days before the event.
• A 7% administrative fee (based on the event price) will be deducted from the refund.
• No refunds for requests received less than 7 days before the event.
• Refunds may take 5-10 business days to process.
• Latinx Therapy may issue refunds at its discretion in special cases.
• Transfers may be available on an event by event basis and with 14 days notice.

4. Latinx Therapy Cancellations

• If Latinx Therapy cancels a course, webinar, or event due to an emergency, a full refund will be issued, and participants will be notified via email and phone if necessary.

Account Termination and Data Removal

Upon cancellation of your membership, we will remove your listing from our database within 30 days. Certain user data, such as payment records and legal agreements, will be retained for up to four years in compliance with California state laws. To request immediate deletion of your personal data, please contact members[@]latinxtherapy.com. Please note that some data may be exempt from deletion due to legal or accounting requirements.

Therapy Dinero Program

Latinx Therapy partners with the Alejandre Foundation, a registered 501(c)(3) nonprofit, to improve access to mental health services for Latinx and Hispanic communities. By participating in the Therapy Dinero program, subscribers agree to provide 8 therapy sessions at a rate of $100 per session to recipients selected by the Foundation.

Participation is subject to selection and program guidelines. More details can be found at alejandrefoundation.org.

Posting Rules

When posting materials to the Site, you may NOT include:

• Links to competing websites
• Copyrighted or proprietary content without permission
• Trade secrets or materials that infringe on intellectual property, privacy, or publicity rights
• Sexually explicit, obscene, defamatory, harassing, abusive, or hateful content
• Content that is offensive or embarrassing to others

You may NOT use your materials to:

• Impersonate others or post false/misleading information
• Advertise, solicit business, or request payments (except in your own directory listing)
• Post chain letters, pyramid schemes, or commercial notices

We do not actively monitor user posts but may remove content that violates these rules at our discretion. If notified of a potential violation, we may investigate and take appropriate action, at our discretion.

Our Relationship to You

This Agreement in no way creates any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between you and Latinx Therapy.

Privacy Policy

Our Privacy Policy is considered part of this Agreement and available on this website.  You must review our Privacy Policy by clicking on this link. If you do not accept and agree to being bound by these Terms, including the LatinxTherapy.com Privacy Policy, do not use this Website or our Services.

Choice of Law and Jurisdiction

These Terms will be treated as if it were executed and performed in Los Angeles, CA and will be governed by and construed in accordance with the laws of California without regard to conflict of laws provisions. In addition, you agree to submit to the personal jurisdiction and venue of such courts.  Any cause of action by you with respect to our Website or Service must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

Dispute Resolution

Any legal controversy or claim arising from or relating to these Terms and/or our Service will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. However, either party retains the right to seek resolution in a small claims court located in Los Angeles, CA, for disputes that qualify under the court’s monetary limits.

Any such controversy or claim will be arbitrated on an individual basis and will not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration will be conducted in Los Angeles, CA, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. You or we may seek any interim or preliminary relief from a court of competent jurisdiction in Los Angeles, CA, necessary to protect the rights or property of you and us pending the completion of arbitration.

Unlawful Activity

We reserve the right to investigate complaints or reported violations of these Terms and take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses, and traffic information.
